Business lease protection is a legal reality that affects both parties to a lease – and ignorance is no excuse. Do you know, for example, that a commercial tenant:

• enjoys protection after six months’ occupation, whether there is a written lease or not;
• is automatically entitled to a new business tenancy at the end of the fixed term; and
• holds over on the same terms and rent, if the landlord or tenant do not seek to invoke a new lease;
and that a commercial landlord:
• can only recover possession by making out a statutory ground, (ignoring a breach of the lease); and
• can exclude all such protection?
